Education Department to probe implementation of gender-inclusive restroom at Colorado high school


The U.S. Department of Education’s Office for Civil Rights is investigating Denver Public Schools for allegedly discriminating against female students by converting a women’s restroom into an all-gender facility. The district now has an exclusive restroom for male students on the second floor of East High School, while there is no restroom for female students. This move is being examined for potential violations of Title IX, which the district must comply with as a recipient of federal financial aid.

The investigation was prompted by local media coverage and is not evidence of wrongdoing, according to Acting Assistant Secretary for Civil Rights Craig Trainor. The district claims the all-gender restroom was added to support all students, including those who may feel uncomfortable in gender-specific facilities.

The installation of multistall all-gender restrooms in other Denver Public Schools locations, as well as potential plans to convert additional facilities, are also under review. The district has stated that students uncomfortable with using the new restroom can use other facilities in the school.

The investigation comes amid broader changes following President Trump’s executive orders targeting gender ideology, federal DEI programs, medical care for transgender minors, and transgender military service. DOJ Pride, an LGBTQ employee resource group at the Department of Justice, has shut down in response to these orders.
