Intel and VLSI to postpone Delaware patent case in light of impending Texas trial


Intel Corp. and VLSI Technology LLC have agreed to halt legal motions in a patent dispute at the urging of a Delaware federal judge. The case revolves around Intel’s claim that it already holds licenses to patents that VLSI is currently asserting. The legal proceedings will be put on hold as a related patent trial in Texas progresses.

U.S. District Judge Colm F. Connolly advised both parties to come to an agreement that would ensure the licensing issues in the Delaware case would be resolved in accordance with any ruling made by U.S. District Judge Alan Albright in Texas. A trial is scheduled in Texas for May 2025, and Judge Connolly mentioned the possibility of a Delaware trial by January 2026 if further legal action is necessary.

The dispute stems from Intel’s declaratory judgment suit, which argues that it already has licenses for the patents in question. The basis of this claim lies in Intel’s agreement with a company acquired by Fortress Investment Group, which manages funds owning VLSI.

Both companies have agreed to the pause in motions following Intel’s lawsuit filing in June, which asserts its ownership of licenses to several patents contested by VLSI in multiple jurisdictions including Delaware, Texas, California, and China. The decision to put legal proceedings on hold will allow for a smoother transition as the case progresses in other jurisdictions.
