Delaware Senate Moves Forward with Same-Sex Marriage Constitutional Amendment and Sussex Wind Legislation

Delaware Legislature Advances Key Bills as Session Nears End

DOVER, DE — As the Delaware Legislature enters the final three weeks of its session, lawmakers returned to the capitol with a flurry of activity. On their first day back, the Delaware Senate passed two significant partisan bills, which will now proceed to the House for consideration.

One major piece of legislation is a constitutional amendment aimed at affirming same-sex marriage rights within the state constitution. This amendment seeks to solidify protections for marriage regardless of gender, race, or national origin, addressing concerns raised in light of shifting political climates surrounding LGBTQ+ rights. State Sen. Russ Huxtable (D-Lewes), who sponsored the bill, emphasized its importance: "This bill sends a strong message that Delaware protects its people… it’s about affirming the equal humanity of every Delawarean."

Notably, State Sen. Eric Buckson (R-Dover South) was the sole Republican to support the amendment, stating he struggles with reconciling his faith and his backing for same-sex marriage. He also expressed concern about discussions linking LGBTQ+ rights to other contentious topics, signaling the complex dynamics within the party.

In addition to the marriage amendment, the Senate passed a resolution designating June as Pride Month in Delaware, which saw some abstentions and opposition from certain Republicans.

Senators also debated a bill overriding Sussex County Council’s denial of a permit for an offshore wind project, arguing that local control over such decisions must be balanced with state needs. Sponsored by State Sen. Stephanie Hansen (D-Middletown), the legislation was defended on the grounds of its statewide implications, ultimately passing along party lines.

As these bills head to the House, the legislative session is poised for intense discussions and potential landmark decisions before its closing in late June.
