Delaware Workplace Safety Program undergoes changes to expand eligibility


A new law in Delaware is set to expand access to the Workplace Safety Program (WSP), allowing more employers to protect their workers. Senate Bill 306, championed by State Sen. Nicole Poore, removes the previous $3,100 annual workers’ compensation premium threshold for WSP eligibility. Now, employers with $5,000 or more in workers’ compensation premiums over three years will automatically qualify for the program. This change is expected to lead to approximately 2,100 additional policies being experience-rated, benefiting about 2,600 more businesses. The Department of Insurance and Compensation Rating Bureau supported this legislation, recognizing the importance of incentivizing businesses to provide safe work environments.

Delaware’s Workplace Safety Program offers premium discounts of up to 19% for businesses that prioritize worker safety. In 2023, participating companies saved a total of $5.6 million through the program. The revised eligibility threshold is expected to increase participation in the program by 15%, benefitting more companies and their employees. The new premium eligibility criteria will take effect on December 1, 2024.
