Delaware Judge Rejects Hunter Biden’s Attempt to Stop Gun Case Proceedings
A Delaware judge has rejected Hunter Biden’s attempt to halt the federal gun case against him, calling his motion “frivolous.” Biden had argued that Special Counsel David Weiss, who is overseeing the case, was not independent and therefore unconstitutional. The judge dismissed this argument, pointing out that the use of congressional appropriations to fund special counsels is well established and that there is no mandate for them to be selected from outside the government to receive funds.
The judge also noted that Biden failed to show irreparable harm in his motion and that criminal prosecution alone is not considered irreparable injury. This is not the first time Biden has tried to dismiss the case – he previously attempted to have his California tax fraud case thrown out on similar grounds, but those efforts were rejected. He is set to stand trial in the gun case on June 3 and the tax fraud case on September 5.
Biden is facing charges related to lying about his drug use when purchasing a gun in 2018 and failing to pay $1.4 million in taxes over three years. Despite his not guilty plea, the judge ruled that his latest attempt to stop the gun case proceedings was frivolous. The case is likely to move to the 3rd US Circuit Court of Appeals for a final appeal before the trial begins.
